Penalties for Identity Theft

In the state of Texas, the crime of identity theft is considered a felony, but the severity of the punishment depends on the number of items/identities that were possessed or transferred by the defendant.

Five or Fewer Items

  • State jail felony
  • 180 days to 2 years in a state prison
  • And/or a fine of up to $10,000

Five to Nine Items

  • 3rd Degree felony
  • 2 to 10 years in a state prison

Ten to Forty-Nine Items

  • 2nd Degree felony
